FED:Zentai war crime case goes to High Court
CANBERRA, Dec 6 AAP - The High Court will determine whether an elderly Perth man can
be extradited to Hungary to face questioning over Holocaust-related war crimes.
Charles Zentai denies accusations he murdered a 18-year-old Jewish man in November
1944 while serving in the Hungarian Army.
Mr Zentai allegedly beat the man to death and threw his body in the Danube River.
He was arrested by Australian Federal Police in 2005 to face extradition proceedings.
The government approved Mr Zentai's extradition to Hungary in November 2009, but the
decision was overturned on appeal in the Federal Court in August.
Now the Home Affairs Minister Brendan O'Connor has been granted leave to appeal the
decision to the High Court.
The Federal Court found that the offence of "war crime" did not exist in Hungarian
law in November 1944, and as a result Mr O'Connor was not able to approve Mr Zentai's
extradition.
The High Court will determine whether the extradition treaty between Australia and
Hungary operates only where the actual offence was an offence at the time it was alleged
to have occurred.
It also will determine whether Mr Zentai's conduct constituted an offence at the time
the incident occurred.
Mr Zentai is on bail pending the High Court's decision.

MELBOURNE, April 1 AAP - A jury has retired to consider its verdict in the trial of
a young Melbourne man charged over a fiery freeway crash that killed his four mates.
Simon Farrugia, 21, is accused of racing his car against a white Commodore driven by
Hasan Burke before the crash on the West Gate Freeway in Melbourne on December 9, 2007.
The prosecution has alleged during his Victorian County Court trial that Farrugia encouraged
his friend Mr Burke to drive at high speeds before Mr Burke's car skidded off the freeway,
hit a tree then burst into flames.
Mr Burke, 18, and his passengers Salih Niyazi, 18, and 17-year-olds George Loizou and
Peter Stavrou, were killed.
Farrugia, of Kings Park, has pleaded not guilty to three counts of culpable driving
causing death and a count of reckless conduct endangering the life of his sole passenger,
Mahmut Temurci.
The jury retired at 2.45pm (AEDT) on Friday to consider its verdict.
Witnesses have testified the two P-platers were racing at speeds of up to 160km/h just
before Mr Burke's car crashed.
Farrugia's defence argues witness accounts are unreliable and pointed to Mr Temurci's
evidence that the cars were not racing.

CANBERRA, Dec 10 AAP - The federal government has indicated an Australian Federal Police
investigation into whether WikiLeaks committed a criminal act could take more than a year.
Attorney-General Robert McClelland has compared the saga of leaked US diplomatic cables
to former Treasury mole Godwin Grech, who sparked the OzCar affair in mid-2009.
Speaking to reporters in Sydney, Mr McClelland pointed out how it took the commonwealth
director of public prosecutions almost 18 months to decide against taking legal action.
"Can I ask people to take a reality check?" he said.
"How long did the investigation into Godwin Grech take before the director of public
prosecutions indicated that was the end of the matter?"
WikiLeaks has continued to embarrass the government, with the latest batch of leaked
cables revealing that Foreign Minister Kevin Rudd derided the contributions of France
and Germany in Afghanistan.
The cables, published in Fairfax newspapers, reported how Mr Rudd likened the European
fight against the Taliban to "organising folk-dancing festivals".
In another of the cables sent to Washington in November 2009 Mr Rudd, as prime minister,
confided that the outlook in Afghanistan "scares the hell out of me".
Opposition Leader Tony Abbott has accused Mr Rudd of mocking the contributions of France
and Germany in Afghanistan.
"They've taken significant casualties in the process of making their contribution and
I don't think it should be scorned," he told reporters in Perth.
Another cable to Washington reveals then foreign minister Stephen Smith was lobbied
by officials in Beijing in April 2009 to ensure China was not singled out as the focus
of Australia's "strategic defence reorientation".
The overtures from China came a month before the release of a defence white paper calling
for Australia to build its knowledge of China's security policies.
WikiLeaks has also released cables showing a difference of opinion on China between
Chief of the Australian Defence Force, Air Chief Marshal Angus Houston, and the then deputy
secretary of the Defence Department, Mike Pezzullo.
The defence chief made public comments in mid-2009 suggesting China had no problems
with the white paper but US officials were given a different perspective from Mr Pezzullo,
who co-ordinated the white paper, the WikiLeaks cables said.
Mr Smith, who is now defence minister, said he spoke with Air Chief Marshal Houston on Friday.
"He advises me there's no reason why he would change any of the comments made on that
occasion nor do I see any reason," he told reporters in Perth.
With WikiLeaks' Australian founder Julian Assange in custody in London, Australian
Greens leader Bob Brown has written to Mr Rudd asking him to guarantee his passport.
Mr Assange is facing deportation to Sweden on sex charges but Deputy Prime Minister
Wayne Swan declined to say if he would be sent to a third country.
One of Mr Assange's lawyers, Jennifer Robinson, said her client was confident of getting
bail next week.
"But he is of course very frustrated to be held in prison because it does impede his
access to his lawyers," she told ABC Radio on Friday.
Rallies in support of WikiLeaks were held in Brisbane, Sydney and Canberra on Friday.

CANBERRA, Aug 4 AAP - Low-income Australians are battling to be heard as the election
campaign rolls on, the Australian Council of Social Service (ACOSS) says.
It is urging the major parties to offer more in their campaigns for those who are doing
it tough - those on welfare and other low-income earners struggling to meet the rising
costs of living.
The peak community sector body released its election wishlist on Wednesday, with housing
affordability and welfare increases at the very top.
The organisation would like to see a housing growth fund established to go towards
ongoing construction and easing the shortage of almost half a million affordable homes.
"Australia has some of the most expensive housing in the world," ACOSS chief executive
Cassandra Goldie said in a statement.
"With rents rising dramatically over the past five years in our capital cities, renters
on income support payments or low wages are struggling to make ends meet."
ACOSS also wants rent assistance to be boosted to 30 per cent, and a commitment to
halve homelessness by 2020.
Welfare assistance is also on ACOSS's radar.
Not only should payments be based on the minimum cost of living, but the entire social
security system should be overhauled to close the gap between different types of payments.
"The social security system pays more to people who are unable to work (pensioners)
and less to people who are searching for a job (unemployed people)," the ACOSS proposal
reads.
"This creates perverse disincentives. People on the Disability Support Pension are
scared to seek paid work in case they subsequently lose the pension and end up on the
Newstart Allowance, which is $120 per week less."
To address the gulf, ACOSS would like to see the Newstart Allowance upped by $45 per week.
More also needs to be done to encourage young people, mature workers and sole parents
to enter or stay in the workforce, with ACOSS advocating a paid work experience program.
"Australia invests less in employment assistance than most wealthy nations," Dr Goldie said.
Training programs should be tailored to suit the individual needs of a jobseeker, she said.
Health costs, tax reform and indigenous care are also areas of need.
ACOSS wants to see compulsory income management dumped - a system embraced by both
Labor and the Liberals.

SA: Drink driver who killed cyclist jailed at least 10 months

ADELAIDE, Aug 12 AAP - A drink driver who crashed into and killed a former work colleague
on a bicycle has been jailed for at least 10 months.
South Australian District Court Judge Michael Boylan said defence submissions that
jailing Darren James Rudland would do him no good were "probably true".
But Judge Boylan said a jail sentence was needed to send a message that the community
did not tolerate drink driving.
Rudland, 40, of McLaren Flat, was drink driving in January last year when his car crashed
into a cyclist - a former work colleague, Alistair Smith.
Mr Smith, a married father of two, died instantly when his head went through the windscreen
of Rudland's car.
Rudland, in "panic and shock", fled the accident scene before returning about an hour
later to confess his involvement in the crash, Judge Boylan said.
Rudland's blood alcohol level was 0.08 per cent or higher, the judge said on Wednesday
when sentencing the vineyard worker to two years and six months jail with a 10-month non-parole
period.
Rudland had been suicidal since the fatal crash, his lawyer, Julian Kelly, previously
told the court.
"You fully realise the seriousness of what you have done and the hurt you have caused
many people," Judge Boylan told Rudland on Wednesday.
The judge accepted that Rudland, who pleaded guilty to causing death by dangerous driving
and leaving an accident scene, didn't see the cyclist.
But he told Rudland his drink driving conviction in 1996 "should have been a warning
to you to never drink and drive again".

Qld: Bligh wishes LNP good luck in leadership vote
BRISBANE, April 2 AAP - Queensland Premier Anna Bligh has wished the Liberal National
Party (LNP) the best of luck in its leadership vote on Thursday.
The LNP's 33 MPs will meet in Brisbane at 11am (AEST) to vote on a new leader and deputy.
Lawrence Springborg vacated the leadership in the wake of the LNP's election loss on
March 21, but is expected to run for the deputy's role.
Brisbane-based MP Tim Nicholls, the Sunshine Coast's Fiona Simpson and Gold Coast MP
John-Paul Langbroek are contesting the leadership.
Ms Bligh told reporters the LNP MPs had an important decision to make, but she declined
to speculate on how it would turn out.
"The return of Mr Springborg is something others will make a judgment on," she said.
"All I say to the new leadership is that I wish them luck."

NSW: O'Shane adds to her list of "firsts"

SYDNEY, Aug 29 AAP - High-profile NSW magistrate Pat O'Shane today added an embarrassing
"first" to her long list of achievements.
In Hornsby Local Court, Ms O'Shane was placed on a 12-month good behaviour bond after
escaping a conviction for drink driving.
She was charged with low-range drink driving on March 8 after being randomly breath
tested on Sydney's north shore.
She returned a blood alcohol concentration (BAC) of 0.08 when tested on Burns Bay Road
at Linley Point, but a later blood test at Chatswood recorded a result of 0.05 - the legal
limit.
She initially pleaded not guilty to the offence, but last month changed her plea.
Her lawyer Andrew Thorpe today said she was upset and embarrassed by her "mistake".
"She's upset, she's made a mistake, she knows she's made a mistake and she's embarrassed,"
he said outside court.
"She regrets profoundly driving whilst having a low range BAC but she is confident
that this is a one-off occurrence and will never re-occur."
Victorian Magistrate Peter Lauritsen, sitting in NSW specifically for today's matter,
took into account Ms O'Shane's "outstanding level of achievement" when he agreed not to
record a conviction against her.
"The number of firsts achieved by her is a relatively long list," Mr Lauritsen said.
The court was told Ms O'Shane was the first Aborigine to become a practising lawyer,
a magistrate, and a judicial officer in NSW.
She was also the first woman to head a government body.
Mr Lauritsen also noted the 67-year-old had received an honorary doctorate of laws
from three NSW universities.
"The number of achievements she has recorded in her life is impressive," Mr Lauritsen said.
Mr Thorpe told reporters his client had recorded many firsts in her life.
"But today she has recorded a first of a very different character, one that she's not
at all proud of - she was charged with drink driving," he said.
Ms O'Shane will remain on the bench, and Mr Thorpe said he did not expect today's matter
to affect her reputation.
"She feels that what has happened does not impact on her personal integrity and she
believes that she can continue to fulfil her role as a serving magistrate of this state
without any interference at all," he said.
Ms O'Shane's early guilty plea and near perfect driving record were also taken into
account by Mr Lauritsen.
She had only recorded two speeding fines in more than 50 years of driving, Mr Lauritsen noted.
He also considered that Ms O'Shane was only travelling a "moderate distance" to her
home in Hunters Hill, about 10 kilometres from the origin of her trip in Mosman, where
she admitted she drank three glasses of champagne.
Ms O'Shane's minimum sentence was "not a rarity", Mr Thorpe said.
She could have faced a maximum fine of $1,100 and six months without a licence.
Ms O'Shane made no comment outside court.

ADELAIDE, April 24 AAP - Three Sydney men have been arrested in Adelaide in connection
with a $30,000 credit card scam.
Police said it was alleged the men bought gift vouchers and other items from metropolitan
stores with fake credit cards, using phony NSW driver's licences for identification.
"The value of the goods obtained by the offenders while they were in Adelaide is believed
to be in excess of $30,000 and included small electrical items, wine, perfumes as well
as the gift vouchers," a police spokesman said.
The men have been remanded in custody to appear in the suburban Christies Beach Magistrates
Court on May 15.

Fed: Labor set to go ahead with Iraq troop withdrawal

CANBERRA, AAP - Australian combat troops will pull out of southern Iraq in the middle
of 2008, fulfilling the Rudd government's promise to exit what it says has been Australia's
greatest strategic policy failure since the Vietnam War.
But not all defence personnel are leaving: the 110-member Baghdad security detachment
will still perform a combat role.
Another 500 personnel will remain at bases around the Persian Gulf, including 190 aboard
the frigate HMAS Arunta, 150 operating with C-130 hercules transport aircraft and 170
flying a pair of AP-3C Orion surveillance aircraft.
By the time troops from the Overwatch Battle Group at Tallil in Iraq start preparing
for their trip home, more than 1,000 Australian soldiers will be based in Oruzgan Province
in south-central Afghanistan, fighting a resurgent Taliban.
The new Labor government remains fully committed to the Afghanistan mission, accusing
its coalition predecessor of making a grave mistake in withdrawing troops on two earlier
occasions and allowing the former Taliban regime and their al-Qaeda allies to re-emerge.
The government has left open the possibility of sending even more troops to what has
already proved the most deadly Australian military mission since Vietnam. Three soldiers
died in Afghanistan within just six weeks in October and November this year.
Trooper David Pearce was killed by a roadside bomb, Sergeant Matthew Locke shot dead
by insurgents and Private Luke Worsley killed during an attack on a Taliban bomb-making
facility.
No-one could accuse the previous government of downplaying the risks.
"There is the distinct possibility of casualties and that should be understood and
prepared for by the Australian public," former prime minister John Howard said in April.
While Afghanistan seems to be inching towards the precipice, Iraq appears to be on
the mend, with incidents of violence dramatically down from the dark days a year ago when
every news bulletin seemed to feature a fresh bombing outrage.
That improvement has been attributed to the US troop surge, with 162,000 American soldiers
now on the ground in Iraq.
It's also been attributed to an unexpected development, the so-called Sunni Awakening,
in which local tribes, previously enthusiastic supporters of the insurgency, threw in
their lot with the Iraqi government.
That's meant that provinces such as Anbar, once the most violent, are now among the
most peaceful as the activities of al-Qaeda insurgents have been curtailed dramatically
.
At the same time, Shi'ite power brokers have sought to rein in their militia groups.
In August, firebrand cleric Moqtada al-Sadr ordered his militia JAM (Jaish al Mahdi)
to stand down. JAM was blamed for much of the violence encountered by Australian and British
forces in southern Iraq.
Iraq's politicians have proved less successful at ironing out their differences.
It's still unclear whether the undoubted improvements can be judged sufficiently sustainable
to allow the US to draw down troop numbers.
Similarly, opinions vary on just how bad it is in Afghanistan. The Senlis Council,
a Paris-based thinktank, warned in November the conflict in Afghanistan had reached crisis
proportions, with the Taliban present in more than half the country and closing in on
the capital Kabul.
NATO disagrees, saying the situation was difficult in some parts of the south but the
Taliban could claim to actually control no more than a few isolated districts.
US strategic think-tank Stratfor says "holding and controlling" were nebulous terms
for Afghanistan and depended more on just who happened to be standing on a particular
piece of ground at a particular moment.
"When districts change hands is it often simply a matter of Afghan national or Taliban
forces driving the other off without any real staying power," it said in a recent analysis.
"Locals in Afghanistan are often adept at playing both sides."
Senlis's principal concern was that NATO's 41,000 troops aren't enough, suggesting
more like 80,000 are needed.
Australia has a related gripe: many national contingents in Afghanistan - such as
Germany, Italy, Spain, France - are located in lower-risk areas of the north with restrictive
caveats on how their troops may be deployed.
Fortunately for Australia, the Netherlands has decided to extend its mission to Afghanistan
for another two years. Australia's task group operates within the larger 1,400-member
Dutch force, relying extensively on their attack helicopters, jet fighters and artillery
for support.
Former defence minister Brendan Nelson was so concerned at the prospects of a Dutch
withdrawal he warned that Australia could not go it alone and might have to pull out.
So what else can defence expect of the new Labor government?
In reality, there won't be great changes. Labor has promised to maintain funding and
to stick to contracts for equipment purchases, such as Super Hornets, signed by the previous
government.
New Foreign Minister Stephen Smith is making an early trip to the US, reassuring the
Bush administration the Anzus alliance will come to no harm.
There will be a new defence white paper, and not before time. The last was in 2000,
albeit with some incremental updates.
A new white paper will take into account the broad security challenges posed by Islamic
terrorism, climate change and failing regional states.
With Iraq out of the way, there will be a greater emphasis on regional relationships
and partnerships.
New attention will be paid to civil-military cooperation, known as CIMIC, as many western
armies have come to realise they are not very good at rebuilding in Iraq and Afghanistan.
Among the millions thrust at voters in the formerly Liberal-held seat of Eden Monaro
was $5 million to establish the Asia-Pacific centre for civil-military cooperation for
Queanbeyan.
Defence force families will receive progressively free dental and health care, a significant
incentive for personnel to stay on.
However, Labor's official 2007 election defence policy makes no mention of a proposal
pushed since 1998 - a national coast guard, combining navy patrol boats, customs vessels
and Coastwatch.
The Howard government argued it wasn't necessary as existing arrangements for border
security, including the new border protection command, were perfectly adequate.
Labor in government seems to agree.

BRISBANE, Feb 15 AAP - There is no need to close to the public current medical board
hearings against disgraced surgeon Jayant Patel, because most of the evidence is already
in the public domain, says the Queensland opposition.
The Queensland Medical Board is seeking to deregister Dr Patel over the clinical treatment
of eight patients at Bundaberg Base Hospital, in the state's south-east, and allegations
he misled the board about his registration.
The case resumed in the Health Practitioners Tribunal on Tuesday.
Lawyers for Queensland Attorney-General Kerry Shine have asked that legal proceedings
be closed to the public, arguing it could prejudice any criminal trial against him.

Opposition legal affairs spokesman Mark McArdle today accused the government of trying
to "conceal" the Patel matter, despite mountains of evidence having been heard during
the Morris and Davies royal commission into the matter.
"The matters being canvassed here appear to be nothing more than what has already appeared
in the public inquiries," Mr McArdle said.
"(Mr) Shine needs to explain the basis of his application and state very clearly whether
evidence is being placed before the tribunal that did not exist at the time of the inquiries
or has not been disclosed elsewhere."
Mr McArdle said that if Mr Shine was going to close the court to the public, then the
determination by the tribunal also needed to be suppressed.
Dr Patel faces a maximum penalty of $100,000, permanent deregistration in Queensland
and notification of the penalty to medical registration boards worldwide if the medical
board's action against him is successful.
The surgeon fled to the US in 2005 after allegations of medical incompetence surfaced
following his two years as director of surgery at Bundaberg Base Hospital.
He has been linked to the deaths of 17 patients.
Warrants were issued for his arrest last November on a number of charges, including
three of manslaughter and five of causing grievous bodily harm.
The federal government is working to extradite him from the US.

The family of JACK THOMAS says the federal government has compounded his fragile mental
state by placing tough restrictions on his movements.
His brother LES says he's concerned about JACK's mental health after a court decision
slapping him with a control order.
He says JACK has had depressive anxiety ever since his time in Pakistan .. which has
been compounded by being held in custody and at different stages during his case.
Under the interim order granted to federal police by the Federal Magistrates Court
.. Mr THOMAS must report to Victoria Police three times a week and is confined to his
house between midnight and 5am.

MELBOURNE, April 23 AAP - Fugitive cocaine importer Tony Mokbel is believed to have
fled Australia via Perth dressed as a priest.
Another theory has the millionaire businessman, who was out on bail, using a false
passport to abandon his cocaine importing trial on March 20.
Mokbel was found guilty in his absence of being involved in importing 2 kg of cocaine
from Mexico to Melbourne in 2000.
An underworld source told the Sunday Herald Sun Mokbel flew to South Africa before
making his way to Beirut.
The whereabouts of Mokbel, 40, has fascinated the nation, as police, journalists and
underworld figures try to pinpoint his hiding spot.
An associate said he would search for him as the convicted drug trafficker owed him
"legal" money.
"We know he has some false passports and we know the names (on them)," the associate said.
"He dressed as an old Lebanese man ... like a Maronite priest to go to Beirut. He flew
to South Africa (Johannesburg), then Cairo, then Beirut.
"He has many friends there ... because he has money, much more than $20 million."
Mokbel is believed to have used the Lebanese name, Sufayar, as one of his aliases, the man says.
The associate said he believed Mokbel had fled because a police informer had implicated
him in murders.
Australian Federal Police agent Jarrod Ragg this week told the court Mokbel was thought
to have moved $20 million offshore before he fled.

SYDNEY, Dec 24 AAP - Firefighters are bracing for conditions to worsen in NSW today
as scorching temperatures and strong winds force a total fire ban across the state.
Extreme fire danger is current nationwide, with total bans in Victoria and NSW as the
mercury skyrockets towards 40 degrees celsius.
Christmas Eve promises shocking conditions, with high temperatures and low humidity,
ahead of a change which is expected to bring winds of up to 90 kph.
The NSW Fire Brigade has warned residents to be ready for any bushfire threat, particularly
in the Hunter Valley.
"I urge all homeowners in urban areas near bushland in the Sydney, Hunter, Illawarra,
Blue Mountains and central coast areas to take the time to ensure they are prepared,"
Commissioner Greg Mullins said yesterday.
About 25 fires in NSW were brought under control on Thursday afternoon, including a
large blaze at Allambie Heights, on Sydney's northern beaches.
About 1,000 hectares of bush were destroyed in a fire at Condobolin, in the state's
central west, while a 407 hectare blaze at Port Stephens, north of Newcastle, was brought
under control.
NSW RFS Commissioner Phil Koperberg has declared a total fire ban for the state until
midnight tonight (Saturday), with the central and far west, and northern Riverina of most
concern.

CANBERRA, Dec 17 AAP - More than 200,000 new Australians were born or arrived over
the past year, with Queenslanders and Western Australians leading the charge.
Between June 2003 and June 2004, the Australian population increased by 238,700 people
to 20,111,300, a 1.2 per cent increase on the year before, the Australian Bureau of Statistics
(ABS) said, adding this remained consistent with past years.
With an increase of 2.1 per cent, Queensland recorded the biggest population rise,
followed by Western Australia (1.7 per cent) and Victoria (1.2 per cent).
The ACT's population had the smallest rise, of 0.2 per cent.
Tasmania enjoyed a one per cent increase, while NSW and the Northern Territory's population
each rose by 0.7 per cent, and South Australia's by 0.5 per cent.
Confirming predictions that Australia's population would continue to age, the average
Australian was 36.4 years old, an increase of almost six years over the past two decades.
South Australian residents were the oldest, at an average of 38.5 years, followed by
Tasmanians at 38.4.
With an average age of 30.6 years, the Northern Territory had the youngest population
of all states and territories.

RUNAWAY HOME AT LAST -- ALTHOUGH 1,700 MILES AWAY
Rachel Spinelli is living in Jamaica.But her parents, Sherry and Chris of Aurora, say they have their daughter back again.
This time, they think it's for good.
Once a freshman cheerleader at West Aurora High School, Rachel made headlines last June when she disappeared while visiting her aunt in Omaha, Neb.
The 15-year-old was missing for a week and eventually was found living with a group of homeless young adults who called themselves the National Association of White People's Party.
It was not the first time Rachel had run away from home.
According to Sherry Spinelli, Rachel started hanging around with a bad crowd, turning more rebellious and angry, after entering high school in the fall of 1996.
Even after they brought her home from Omaha, Spinelli says, Rachel continued to run away over and over again.
Local treatment centers did no good.
Spinelli says the first night Rachel was home after three weeks of in- and out-patient care, she tied her bedroom sheets together and climbed out the front window of the family's home.
Then she stole her parents' bank access card, cleaned out their account and headed west again.
Gone every other day
Rachel made it to within an hour of Omaha before the Amtrak police found her.
But the same day her parents brought her back to Aurora, she ran again.
Then, says Spinelli, her daughter "proceeded to run away every other day.
"When we would catch up with her, she would be drugged up.
And it got to the point where she was running with strangers now instead of old friends. It was taking us longer to find her each time, and she was more belligerent each time."
A psychiatrist recommended that Rachel be placed in a long-term locked facility.
But in the state of Illinois, a teen cannot be kept against his or her will.
And the cost of the programs they encountered, says Spinelli, ran from $4,000 to $6,000 a month.
In the meantime, the family was falling apart.
The younger siblings were greatly affected by the chaos their big sister created.
Sherry and Chris eventually filed bankruptcy because they missed so much work looking for Rachel, and because of the cost of their many attempts to treat her.
"We were at our wit's end," recalls Spinelli.
"We didn't know where else to turn."

The family eventually found the answer on the Internet, where they learned about an organization called Teen Help, a referral center that works with four privately owned residential specialty schools dealing directly with teen-age behavior modification.
In addition to attending school six days a week, eight hours a day, the kids take part in a series of seminars designed to help them regain their self-esteem and develop values and tools they need to grow into adults.
The Spinellis chose to put Rachel in Jamaica because of the cultural shock often needed to straighten up kids who are so out of control.
Also, because the cost of living is lower in off-shore sites, the program was less expensive.
Still, in order to cover the $2,100-a-month tuition, Sherry Spinelli went back to work full time as a day-care provider, the family sold their two late-model cars and they moved into a more modest home.
But their decidedly more frugal lifestyle is all worth it when they see how far their daughter has come.
Although she's only halfway through a six-part program, Rachel corresponds with her parents regularly now, is repentant about her past and excited for her future.
"She's back," says Spinelli.
"And we couldn't be more thrilled."

Internet-based CBT works for depression, phobias, anxiety.(MENTAL HEALTH)
EXPERT ANALYSIS FROM THE ANNUAL MEETING OF THE AMERICAN PSYCHIATRIC ASSOCIATION
HONOLULU--Internet-based cognitive-behavioral therapy could cure half of patients with internalizing mental disorders, including depression, social phobia, panic disorder, and generalized anxiety disorder, a review of data suggests.
Internalizing disorders account for half of mental disorders, Dr. Gavin P. Andrews said at the meeting.
"A quarter of the burden of mental disorders is potentially removable by Internet-based cognitive-behavioral therapy" (CBT), said Dr. Andrews, professor of psychiatry at the University of New South Wales, Sydney. "If our profession could get a handle on effective treatment for internalizing disorders, we'd make a fundamental move forward."
Internet-based CBT is a program whereby the patient is in e-mail contact with the person directing the therapy, which consists of psychoeducation and exercises completed online. Dr. Andrews and his associates conducted a review of the literature and meta-analysis of data from 22 studies of Internet-based CBT involving 1 (746 patients. The effect-size superiority over comparison groups was larger than the effect-size superiority traditionally seen for treatment of anxiety disorders with face-to-face CBT or selective serotonin reuptake inhibitors (SSRIs), compared with control groups, he said.
For each disorder (depression, social phobia, panic disorder, and generalized anxiety disorder), the number needed to treat with Internet-based CBT to show an effect was two (PLoS One 20l0;5:el3196).
"Treat two people and one gets better. This is powerful treatment in psychiatry. It's powerful treatment in medicine," said Dr. Andrews, a member of the Anxiety, Obsessive-Compulsive Spectrum, Posttraumatic and Dissociative Disorders Work Group for the DSM-5.
The effects of Internet-based CBT appear to last, he added. Although the median follow-up time in the studies was 6 months, some Swedish studies had 18-month follow-up data.
"There was no hint of relapse reported in any study, which is just foreign to my experience," he said. "Depression is supposed to be a relapsing and recurring disorder. What on earth is it doing just disappearing after someone does CBT over the Web? This is not what any of us were trained for."
Diagnosis or the type of Internet-based CBT did not predict results. "It's as though these four disorders have shared commonalities, because they're responding identically," he said.
Dr. Andrews said the study was commissioned by the Journal of the American Medical Association, which declined to publish the results. He and his associates have now published 15 randomized, controlled trials, including about 1,500 people showing the effectiveness of Internet-based CBT, he said.
In a recent randomized, controlled study, he and his associates tested the third iteration of transdiagnostic Internet-based CBT that they developed for patients with depression, social phobia, panic disorder, or generalized anxiety disorder. The study compared 75 patients who underwent the clinician-guided Internet-based CBT or were on a waiting list for treatment (Behav. Res. Therapy 2011 [doi: 10.1016/j.brat.2011.03.007]). The effect-size superiority of the Internet-based CBT was 0.6 as measured on the Depression Anxiety Stress Scales, he said, roughly equivalent to effect sizes seen previously with face-to-face CBT or SSRI treatment. Measures of adherence showed that 76% of patients finished all eight of the Internet-based CBT lessons. Therapist guidance averaged 70 minutes per patient by e-mail or phone over a 10-week period. About 90% of patients said they would recommend the treatment.
Adherence to Internet-based CBT in Dr. Andrews' studies averages 75% of patients--"definitely better than what we see in our face-to-face clinics," he said. Data from about 1,300 Australian primary care physicians using Internet-based CBT with their patients suggest that the adherence rate is 54%. "Even 54% is extraordinarily good," Dr. Andrews said.
A separate analysis by Dr. Andrews and his associates suggests that patients using Internet-based CBT are similar to those seen in face-to-face CBT clinics. Among patients with depression, most are treatment experienced, with a history of multiple episodes that began before age 20. "Those would not be easy cases," he said.

LAST week, I wrote that the best present I ever bought myself was my Internet radio, which picks up 25,000 stations worldwide, including dylanradio.com, the one I'd choose if someone sought to weld the dial in place. This week, I have to report a possible competitor. I've just bought myself a Kelly Kettle, which, if you haven't heard of it already, may well be the greatest invention you've never heard of.
It's a device for boiling water and cooking outdoors. It works on something like the opposite of the principle of a flask and has a similar shape, except bigger. there's a kind of a chimney up the middle, in which to light a small fire on a base-pan underneath, using sticks and newspaper. this boils the water, which makes the most exquisite tea. You can also cook sausages or whatnot, either on top of the kettle or on the cinders that collect in the basepan.
It's an Irish thing, being made here by the Kelly Kettle Company, Ballina (www.kellykettle.com). Apparently they've been producing them since the early 1900s, although they went out of fashion for a while, what with Primus stoves and all those modern gizmos.
I've got the full kit: pot, pan, and even a stand to put on top to make a small 'range' on which you can cook while the water's boiling.
So I'm off now to play the father in The Swiss Family Robinson. Over the weekend, I hope to head up the back of Ben Bulben, surviving on my wits and ingenuity, in an inhospitable wilderness stalked by predators and foes but determined to make it to the frontier. If it's too hot for tea, I plan to hunt down some wild rabbits and fry up some steaks on this here stove o' mine.

The collaboration covers the deployment of Rovi's Nowtilus entertainment delivery platform to power a comprehensive Video on Demand offer via KabelKiosk interaktiv, the interactive option to be available in the KabelKiosk service. In addition, Rovi will supply technical and editorial services, digitisation of content and comprehensive support to operate the hybrid application. KabelKiosk interaktiv will be available on HbbTV receivers and TV screens. The commercial launch of the service is planned for third quarter 2011 for the networks of KabelKiosk partners.
KabelKiosk interaktiv has been developed by Eutelsat Germany to allow a smart connection of TV and Internet for a smooth transition from the linear KabelKiosk TV-offering to non-linear content. Red button applications support on-demand information and video clips to complement the linear TV channels. The distribution of individual content by network operators is an additional feature for recent news and network-specific offerings. Network operators will be able to deploy their own design and marketing to brand the hybrid service. The completely revised layout of KabelKiosk interaktiv offers a range of new features and optimised navigation. An intuitive user navigation facilitates quick selection of content with only a few keys of the remote control.

HOMELESS MAN FROM EDWARDSVILLE SENTENCED ON CHILD PORNOGRAPHY CHARGE.
Fairview Heights, Ill. -- The following information was released by the United States Attorney's Office for the Southern District of Illinois:
Stephen R. Wigginton, United States Attorney for the Southern District of Illinois, announced today that on April 29, 2011, Gary E. Shields, of Edwardsville, Ill.-, was sentenced in federal district court in East St. Louis to 120 months' imprisonment, a life term of supervised release, a $100 special assessment, and a fine of $500 following his plea of guilty to a one-count Indictment charging him with Possession of Child Pornography.
Shields had been convicted previously of possession of child pornography in Madison County Case No. 07-CF-2322 on October 29, 2007.
In a pleading filed with the Court on January 27, 2011, the United States provided the following facts concerning the case:
Defendant was convicted of possession of child pornography in violation of 720 ILCS, Section 11-20.1(a)(6), on or about October 29, 2007, in Madison County Case No. 07-CF-2322, for which he was sentenced to probation.
Defendant has no permanent address - instead, he owns a truck and a small trailer/mobile home, which he moves around from time to time.
In April, 2010, his truck was parked on an Auto Zone lot near a Blimpie's Restaurant in Madison county for several days. He was observed by a clerk at Blimpie's, who saw him disappear into the rest room with a magazine or book; he stayed there for 45 minutes. He later charged something to his credit card. He also explained to the clerk that he was convicted of something for which he could not move from state to state. The clerk searched the internet for his name and discovered he was on a sex registry list.
The clerk became aware that Defendant moved his truck onto the Lewis and Clark campus, so she reported him to the police. On April 9, 2010, Edwardsville Police approached Defendant because by virtue of his prior conviction and sex registration, he should not have been on the campus. Defendant admitted to police that he was in possession of child pornography. Defendant gave police consent to search his vehicle; police found a thumb drive in the vehicle. The thumb drive contained numerous images of child pornography depicting children under age 18 (including one video of a child under 12 years old) engaging in sexually explicit activity. The production of each such images of child pornography involved the use of a minor engaged in sexually explicit conduct. Each of such images of child pornography in fact depicted one or more children under age 18 engaging in sexually explicit conduct.
Defendant told police that he had downloaded the images from the internet onto his thumb drive via a netbook that he had purchased at the Jerseyville Walmart. He accessed the internet at the Edwardsville Library. He later returned the computer to the Walmart and got his money back. He retained the images on the thumb drive and he viewed the images from the thumb drive by placing the thumb drive on an electronic picture frame that accommodates thumb drives.
Also discovered in Defendant's possession were numerous writings, in which Defendant expresses his belief that child pornography should be acceptable in society and that sex between adults and children (including the adults' own children) should be acceptable and not illegal.
The case was prosecuted by Assistant United States Attorney Stephen B. Clark and was investigated by the Edwardsville Police Department.

Know your history: lessons from the past illustrate why it's unwise to pull out of a bear market.(INVESTMENT STRATEGIES)

DOUG WHITE IS NO INVESTING NOVICE. An entrepreneur whose 17-year-old company sells and services Apple computers small and mid-sized businesses, White understands that markets don't always go up. But when they dive, it still hurts. "I've lost more money in my pension this year than I've put in to save on taxes," says the 53-year-old Pennsylvanian about his Simplified Employee Pension Individual Retirement Account. Even so, White resisted the urge to clump stocks. He and wife, Celeste, 52, believe the only way to a comfortable retirement is to cast their lot with the market. "We don't come from affluent families; we don't have anything to rely on other than our own planning," says White, calculating that he may need to postpone retirement by five years to make up lost ground. "We have no choice but to stay the course."
White is taking a page from history. His continued faith in stocks is supported by decades of market data. History shows that stocks generate better returns than all other investments. One dollar invested in stocks in 1926 would have been worth $3,246 by the end of 2007. By comparison, the same amount in treasury bills would add up to $20.19.
The only reason to sell now is if you believe the stock market will continue to decline--by a lot. But, consider this: since 1929, the average bear market decline in the S&P is 38%. This bear, however, has handed investors a 43% drop from Oct. 9, 2007 through the end of October 2008, according to Standard & Poor's Equity Research. Although further dips could occur, the probability of the market falling much more is growing unlikely. While it's true that the crash of 1929 ended with an 86% decline, there are a number of important factors at play now that weren't present prior to the Great Depression. "Back then you had a government trying to raise taxes, tighten credit, not bail out any companies, which is the opposite of what's happening now," says Sam Stovall, chief investment strategist with Standard & Poor's Equity Research. Still, the S&P'S drop in 2008 has evaporated roughly $2 trillion in retirement savings, and that's enough to make even the most rational investor frightened.
But giving into fear won't lead to long-term wealth. If anything, it's a detour to a financial dead end. Selling now only locks in losses and closes off any possibility of recouping. Besides, bear markets always give way to good times. In the 12 months following the last 10 market bottoms (1949 to 2002), stock returns have averaged 32%.
MISSING OUT
Investors might be inclined to pull out now and dive back into stocks once there are signs of recovery. If only it were that simple. The problem is rebounds are usually fast and unexpected, making it difficult for investors who've retreated to know when to get back in. That's because the stock market is a forward-looking mechanism, anticipating the business the business environment about six to nine months ahead. So, stocks historically start improving before the economy does. Markets usually bottom about halfway through a recession, says Stovall. And the upside is easy to miss. Nearly 75% of the gain following a market bottom occurs within the first six months, according to Ned Davis Research. Even then, investors still might not see signs of an improving economy.
It takes surprisingly little to miss out on the best stock returns. Just missing out on the market's 10 best days during a recovery can have a big impact on overall returns. For the 10-year period between 1998 and 2007, stocks gained a cumulative 77.6%. But if an investor missed the 10 best trading days during that time, the return was just 11.8%, according to Vanguard. "Just as there is risk being in the market, there is risk being out of the market," says Alfred Osbourne, a senior financial planner with Ameriprise Financial in East Meadow, New York.

Sadly, investors don't always act rationally. Emotion--not reason--often dictates how we respond to market gyrations. Investors tend to overreact when stocks decline and become overly fearful when they fall. "In up markets there is a bias," explains Michael Pompian, a director of the private wealth practice with Hammond Associates in St. Louis and author of a book on behavioral finance. "People don't look at history. They only look at the most recent results, and all of a sudden they find they've bought at or near the peak." Indeed, skittish investors have demonstrated poor timing. In the early months of 2000, just as the Internet bubble was taking its last gasps, investors poured record amounts of new money into equity mutual funds, much of it going to technology offerings. By early 2002, after two years of declines, these investors had had enough and were withdrawing their funds in record numbers--just as stocks were beginning to recover. From its bottom in 2002, the S&P went on to return 22% in the following 12 months. In a well-known study, Dalbar, a financial research services firm, found that while U.S. equity funds had a long-term annualized return of 11.9% for the 20-year period ended Dec. 31, 2004, individual mutual fund shareholders squeezed out only a 3.7% gain, primarily the result of entering and exiting stock funds at the wrong time.
MOVING FORWARD
So if selling isn't the right thing to do, what is? How can investors make their portfolios smarter and better poised to withstand periodic shocks? The key is allocating assets in terms of risk tolerance and investment horizon. "This may be a wake-up call for people who realized they were too heavy in equities," says Christine Fahlund, senior financial planner at T. Rowe Price in Baltimore. An overwhelmingly stock-heavy portfolio is perfectly sensible for a young investor who's nowhere near retirement. Someone with a need for retirement income, say, in the next five years, should maintain a mixed portfolio of stocks, bonds, and cash to ride out declines.
T. Rowe Price found that a balanced portfolio of 60% stocks, 30% bonds, and 10% cash declined significantly less during the market correction of 2000 to 2002 and performed only a little worse during the ensuing rebound through 2007 than an all-stock portfolio. You don't give up much on the upside to protect yourself significantly on the downside. Over the full market cycle from 2000 to 2007, $10,000 invested in a stock, bond, and cash portfolio grew to $48,107, T. Rowe estimates. Over the same period, an all-stock portfolio grew to just $28,316.
Having a balanced portfolio is one part of managing your risk. Rebalancing at regular intervals will help keep a portfolio from getting too out of whack by selling winners and buying laggards. A good place to look would be NDR, whose historic data suggests healthcare and consumer staples--food, beverages, and household products--are likely to be the best performing sectors in the coming year. The firm found this to be true, on average six and twelve months after the start of the last five recessions dating back to 1973. Don't be afraid to rebalance. After all, it follows the market's most time-tested piece of advice: Buy low and sell high.
